1. Introduction

1.1 BizFreight operates as an independent freight forwarding broker (“Broker”), introducing customers to third-party service providers for freight forwarding, logistics, customs, and related services. BizFreight does not itself act as a carrier, warehouse operator, or transport provider. All transport and operational services are performed by third-party carriers or agents under their own terms and conditions.

1.2 These Terms & Conditions (“Terms”), together with the FIATA Model Rules for Freight Forwarding Services (the “FIATA Rules”), form the basis of the agreement between BizFreight and the Customer (“you”).

1.3 If there is a conflict between these Terms and the FIATA Rules, the FIATA Rules shall prevail, except where inconsistent with mandatory Australian law.

2. Definitions

​

Broker: BizFreight Pty Ltd, acting as an intermediary to arrange services with third-party providers.

 

Service Provider: any third-party carrier, warehouse, customs broker, or logistics provider engaged by BizFreight on your behalf.

 

Freight Forwarding Services: services relating to the arrangement of carriage, consolidation, storage, handling, customs clearance, or distribution of Goods.

Goods: any item, cargo, container, or packaging that is subject to the Services.

 

Customer: the party contracting BizFreight for brokerage services.

3. Applicability of FIATA Rules

​

3.1 The FIATA Rules apply when incorporated by reference in writing, orally, or otherwise.

3.2 The FIATA Rules supersede conflicting terms herein, except where inconsistent with mandatory Australian law.

4. Liability of BizFreight

 

4.1 BizFreight acts solely as a broker arranging services with third-party carriers and logistics providers.

4.2 All carriage, storage, and handling of Goods is subject to the terms and conditions of carriage of the performing carrier and/or the FIATA Model Rules for Freight Forwarding Services.

4.3 BizFreight is not liable for loss, damage, delay, or misdelivery of Goods except as provided under the carrier’s terms of carriage and/or the FIATA Rules.

4.4 To the fullest extent permitted by law, BizFreight’s liability shall not exceed that which would apply if the claim were made directly against the carrier.

5. Customer Obligations

​

5.1 You must provide accurate and complete information regarding the Goods.

5.2 You must comply with all applicable laws, regulations, and customs requirements.

5.3 You acknowledge that contracts of carriage and related services are concluded directly between you and the Service Providers. BizFreight acts only as a broker arranging such services.

5.4 You indemnify BizFreight for losses arising from incorrect instructions, undeclared dangerous goods, or regulatory breaches.

 

6. Insurance

6.1 BizFreight does not insure Goods. Insurance is arranged only upon your written instruction and at your cost.
 

6.2 Insurance is subject to the insurer’s policy conditions, and BizFreight accepts no liability for insurer performance.

 

7. Charges, Payment & Lien

​

7.1 Charges are based on agreed brokerage fees, tariffs, or quotations. Duties, taxes, and related charges are payable by you.
 

7.2 BizFreight and/or provider has a general lien over documents and amounts collected for sums owed.
 

7.3 Payment terms are as set out in quotations or invoices. Interest may apply on overdue accounts.

8. Claims, Notice & Time Limits

​

8.1 Claims relating to loss, damage, or delay must be notified in writing:

• Visible damage: upon delivery or within 6 days.

• Non-visible issues: within 14 days of discovery.

8.2 Legal action must be initiated within 9 months of delivery or expected delivery, unless otherwise required by law.

 

9. Route, Mode & Transit

​

9.1 BizFreight may select or vary Service Providers, routes, or modes of transport unless otherwise agreed.

9.2 Incomplete or incorrect instructions are at the Customer’s risk and expense.

10. Jurisdiction & Governing Law

​

These Terms and the FIATA Rules apply. Disputes shall be submitted to the Courts of Victoria unless otherwise agreed.

 

11. Severability and Variation

​

11.1 If any provision is unenforceable, the remainder of the Terms remains effective.

11.2 BizFreight may vary these Terms by publishing updates on its website.

12. Exclusion of Implied Terms

​

To the fullest extent permitted by law, all implied warranties, conditions, or guarantees not expressly stated are excluded.
